These General Terms and Conditions ("GTC") are entered by and between Hectic Books Kft., Intra-Community VAT: HU32595251, with an address at 31-33 Nógrádi utca, Budapest 1125, Hungary, represented by its CEO, Ms. Tímea Urbantsok ("Publisher") and the Client ("Client"), for any online purchase done via the Publisher's website at hecticbooks.com ("the Website").
The Website is operated by Squarespace, Inc.
Director of Publication is Hectic Books Kft.
SECTION 1 - Scope
These GTC shall apply to all Orders placed trough Publisher’s Website. These GTC and the online order ("The Order") constitute the entire contractual documents binding between Publisher and Client.
SECTION 2 - Presentation of books
The presentation of the books on the Website does not represent a legally binding offer but a non-binding online catalogue. Each book is accompanied by a description and is offered for sale, within the limits of available stocks.
SECTION 3 - Orders
The Client who wishes to purchase a book on the Website must fill first the Order form. To confirm the Order, Client must tick the box "I have read and accepted the General Terms and Conditions" followed by the action "confirm", in order to be bound by his/her "double click". The "double click" constitutes an electronic signature, which has the same value as a written signature. This acceptance will be followed by immediate payment of the Order. Publisher will send Client, by email, an order confirmation and the paid invoice, subject to the acceptance of the payment by Client's bank.
SECTION 4 - Prices
Prices are quoted on the Website, inclusive of taxes and exclusive of delivery costs. For deliveries, Client is responsible for the distance-based delivery fee and any additional taxes and customs fees. Publisher reserves the right to change prices at any time, only the price indicated on the Website is binding between the parties. The payment method is mentioned on the Website. In the event non-payment, Publisher shall suspend or cancel the purchase and/or withhold the products ordered.
SECTION 5 - Deliveries
Publisher will deliver the books in accordance with the choice of Client, either to the delivery address specified by Client. Publisher declines all responsibility in case of incorrect address. The risks shall be borne by the Buyer from the moment the works have left the Publisher's premises. In the event of unavailability of a book, Client shall be informed promptly and shall have the right to be reimbursed within thirty (30) days of payment.
SECTION 6 - Withdraw Right
The non-professional Client has a right to repeal any purchase without justification, within fourteen (14) days from the date of receipts of the books. To be eligible for a refund, Client’s item must be in the same condition as he/she received it, unworn or unused, with tags, and in its original shipping packaging.
To start a return, Client can contact us at books.hectic@gmail.com. If the return is accepted, we will send a return shipping label, as well as instructions on how and where to send the package. Items sent back to us without first requesting a return will not be accepted.
Publisher inspects the return of the book, and notifies Client if refund is approved or not. If approved, Client has three options: he/she can get an exchange, which means that he/she can choose another book from the selection of Publisher, or, he/she can request a credit note equal to his/her payment (without delivery cost), which is going to be valid for one and a half year (18 months) from the date of its receipt by Client, thus with this, Client can also buy Publisher’s new books, or, Client can get a refund on his/her original payment method. In the latter case, Publisher undertakes to give Client the refund of the amount paid with the exception of the delivery costs within a maximum period of thirty (30) days.
SECTION 7 - Warranties
All works sold by Publisher benefit from the legal warranty provided by the 2019/771 European Union Directive and the Hungarian Civil Code.
SECTION 8 - Liability
Publisher's liability cannot be sought if the non-performance of the contract is attributable either to Client, or to the unforeseeable and insurmountable action of a third party, or to a case of force majeure.
SECTION 9 - Intellectual property
Publisher will retain all right, title and interest in and to photographs, images and artworks. These Works are protected under intellectual property law and may not be reproduced, with the exception of reproductions made to promote the works sold on the Website, for which Publisher grants a non-exclusive licence for use.
SECTION 10 - Personal data
In accordance with the General Data Protection Regulation 2016/679 (the "GDPR") of the European Union, and the Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information of the Hungarian Civil Code, Publisher may collect and process Client’s personal data. To this end, Publisher informs Client that these personal data are mandatory for the registration on the Website and for any sale. Publisher also reserves the right, to transmit the collected data to its own clients. Clients may exercise his/her right of access, his/her right of rectification and deletion, his/her right to limit processing, his/her right to data portability as well as his/her right of opposition by contacting Publisher by email at books.hectic@gmail.com or by phone call on +36 30 722 7996.
SECTION 11 - Cookies
When browsing the Website, information may be recorded in "cookie" files on the Client’s computer or terminal. A cookie is a small file, which does not allow the identification of Client but records information relating to his/her navigation and allows personalized offers or measures of audience. Publisher’s Website uses essential and non-essential cookies. Essential cookies are are necessary to browse a website, and thus can not be disabled. Non-essential cookies provide quantitative measures of website visitors. With the usage of these cookies the Website is able to count visits and traffic sources to improve the performance. Client's consent will be requested prior to the installation of a non-essential cookie by means of a banner that will appear on the consulted page. With this banner, Client will be able to manage his/her non-essential cookie preferences. Client may withdraw at any time his/her consent given prior to the implantation of a cookie. Refusal to install a cookie may result in the impossibility to access certain services.
SECTION 12 - Modifications
Publisher reserves the right to amend these GTC from time to time.
SECTION 13 - Law and Jurisdiction
These GTC shall be governed by and construed in accordance with the laws of the Hungarian Civil Code. Any disputes relating to these GTC shall be subject to the exclusive jurisdiction of the courts of Hungary.
